Exclusive Right to Sell Listing Agreement

Thank you for choosing Powerhouse Realty Group to market your property at: , hereby referred to as “the Property.” We have outlined the various steps we will take in our Traditional Marketing package to bring you as many well-qualified buyers as possible and we assure you that we are committed to getting you the best possible price in the shortest possible time.

The following reflects the agreement between us. If this meets with your approval, please sign as noted below.

You have employed Powerhouse Realty Group as a real estate broker with Exclusive Right to Sell the Property. You represent that you are the owner of the Property.

This agreement shall be effective as of . It shall continue in full force and effect until Expiration

Powerhouse Realty Group is authorized to offer the property for sale at a price of $

Powerhouse Realty Group is authorized to solicit the cooperation of other licensed real estate brokers who will act as agents for the prospective purchasers, and to work with them on a cooperating basis. If the property is sold pursuant to this agreement, Powerhouse Realty Group’s fee for service to be paid by you shall be three percent (3.00%) of the total sales price of the Property. In the event another licensed real estate broker represents the purchaser(s) in this transaction, Powerhouse Realty Group shall pay the Cooperating broker a fee equal to for service by separate agreement with such broker and in no such event shall the fee for service paid by you exceed of the selling price.

During the term of this exclusive right, you agree to refer to Powerhouse Realty Group all inquiries, proposals and offers received by you regarding the property, including, but not limited to those from principals and other brokers. You agree to conduct all negotiations with respect to the sale or other disposition of the property solely and exclusively through Powerhouse Realty Group. The property will be offered only for sale during the term of this agreement unless otherwise agreed to by you and Powerhouse Realty Group.

Within three (3) business days after the expiration of the Exclusive Listing, the Exclusive Broker shall deliver to the Owner a list of no more than six (6) names of persons who visited the Exclusive Property during the term of the Exclusive Listing. If within ninety (90) days after the expiration of the Exclusive Listing a sales contract or lease for the Exclusive Property is executed with one of the six (6) persons on the list, the Exclusive Broker shall be entitled to the commission provided for in the Exclusive Listing.

In the event that any settlement monies received by you due to buyer’s default on a fully executed contract with all contingencies fulfilled, Powerhouse Realty Group will be entitled to 10% of said monies.

Powerhouse Realty Group represents you, the seller on Powerhouse Realty Group’s exclusives. If another agent of Powerhouse Realty Group represents the buyer, you agree that Powerhouse Realty Group will be dual agent with designated agents representing you, the seller, and the buyer. Powerhouse Realty Group represents the buyer when showing the exclusives of other real estate firms. Pursuant to section 443 of Article 12 of the New York Real Property Law, the undersigned consents to dual agency should that situation arise.

Each party agrees to submit to binding arbitration through the American Arbitration Association in New York City for any disputes arising under the terms of this agreement. This agreement shall be governed and interpreted pursuant to New York law. The prevailing party shall be entitled to all costs and fees associated with the arbitration process.

FIRE ME GUARANTEE

If at anytime, as long as we do not have an executed purchase contract, you wish to cancel this listing agreement you are able to do so at anytime, for any reason, without any hassle, cost or obligation.

***SPECIAL LEAD PAINT NOTIFICATION***

If your property was built before 1978, you have an obligation to disclose to the Purchaser and Purchaser’s agent all information known to you regarding the presence of laid-based paint and lead-based paint hazards within this target housing. All information known to the Seller’s agent regarding the presence of lead-based paint and lead-based paint hazards within this target housing will be disclosed to the Purchaser. Federal laws require that the Purchaser be given a ten (10) calendar day period (unless otherwise agreed in writing) to conduct a risk assessment or inspection for the presence of laid-based paint before becoming obligated under the Contract of Sale to purchase the target housing.

Powerhouse Realty Group is committed to upholding the city, state and federal Fair Housing requirements prohibiting discrimination.

This agreement shall bind and benefit the personal representatives, successors or assigns of the parties.

Facsimile signatures shall be construed and considered original signatures for purposes of enforcement of the terms of this Agreement. Same may be executed in counterparts and taken together shall constitute the whole of this Agreement.

This agreement may be not changed, rescinded, or modified except in writing, signed by both Seller and Powerhouse Realty Group. Again, we appreciate your confidence and look forward to working with you.
