Exclusive Agency Listing Agreement

This shall confirm our agreement that you have engaged Powerhouse Realty Group to act as your exclusive agent with the right to market and sell your property at: . Seller agrees to pay an upfront flat fee of $995.00 to cover the marketing services as described in the Flat Fee Marketing package. Seller does have the option to Upgrade the marketing package at seller's choice.

We hereby agree to use our best efforts to bring about the sale of your CondoCoopSingle FamilyTownhomeMulti-familyDuplexTriplexFourplex property and you hereby agree to employ us exclusively as agents for the sale of said property. This exclusive agency agreement means that if the apartment is sold during the listing term, you will owe us the commission unless you procure the buyer through your own efforts and in such a case there shall be no commission due. The asking price at which we may offer this property is $ and on such other terms as you may advise us.

It is understood and agreed that you will pay Powerhouse Realty Group a commission equal to 3.00% of the sales price, not withstanding that it may be different from the asking price set forth above. When earned, this commission will be payable at closing. However, we shall not be entitled to any commission and you shall not be liable to us in any way, if the closing shall fail to take place for any reason whatsoever, except for your willful default under the “contract of sale” after the same shall have been entered into with our company.

It is further our understanding that this agreement will begin the date you sign this and continue for a period not to exceed one hundred eighty (180) days. Within ten (10) business days of termination, we shall deliver to you a list of no more than thirty (30) names of prospective purchasers who have visited the property. If within six (6) months after the date of termination, the property is sold to an individual on such list, we shall receive from you the full commission referred to above, as though such transaction had been consummated during the term of this agreement.

It is understood that you will refer to us all inquiries you may receive from real estate brokers regarding the sale of your property.

If at anytime, as long as we do not have an executed purchase contract, you wish to cancel this listing agreement you are able to do so at anytime, for any reason, without any hassle, cost or obligation. However, upon cancellation, the $995 fee shall be deemed earned and non-refundable.

This agreement constitutes the entire agreement between us and cannot be changed or modified except by in writing by the party to be charged. The agreement shall be binding upon and shall inure to the benefit of each of our respective successors and us. Either party may not assign this agreement.
